Blue Ocean Interactive Marketing (“Blue Ocean,” “we,” “us,” or “our”) is committed to protecting the privacy of our website visitors, clients, suppliers, job applicants, and employees. This policy applies to personal information we handle in the course of our commercial activities, including through our website at blueoceaninteractive.com, our client portal, and our marketing, design, and web services.

We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. Our practices are designed to meet or exceed these requirements.

Blue Ocean serves clients across Canada. PIPEDA sets the national standard for how private-sector organizations handle personal information in the course of commercial activity, and it applies to our dealings with clients, leads, and website visitors in every province and territory. Where a province has its own private-sector privacy law — currently Alberta, British Columbia, and Quebec — that law may apply to activity within that province, and we comply with it as applicable.

2. What personal information we collect

Information you provide to us directly. This includes information you give us when you:

  • Submit a contact, quote, or inquiry form (for example, name, email, phone number, company, and the details of your message)
  • Register for or use our client portal
  • Make a payment or set up billing
  • Apply for a job with us (for example, resume, work history, and related details)
  • Subscribe to our newsletter or marketing communications

Information we collect automatically. When you visit our website, our servers and analytics tools automatically collect certain standard information, which may include:

  • Service providers. We share personal information with third parties that perform services on our behalf — such as hosting, analytics, advertising, payment processing, and CRM/email platforms — who are authorized to use it only as necessary to provide those services.
  • Cross-border processing. Some of our service providers are located outside Canada, including in the United States. As a result, your personal information may be stored or processed outside Canada and may be subject to the laws of those jurisdictions, including lawful access by courts, law enforcement, and government authorities. We take reasonable steps to ensure your information is protected in accordance with this policy wherever it is processed.
  • Legal and safety reasons. We may disclose personal information where required or permitted by law, to comply with legal process, or to protect our rights, safety, or property or that of others.
  • Business transactions. In connection with a proposed or actual sale, merger, or reorganization of our business, personal information may be disclosed to the parties involved, subject to appropriate safeguards.

7. Email marketing (CASL)

Our commercial electronic messages comply with Canada’s Anti-Spam Legislation (CASL). We send marketing emails only to recipients who have provided the required consent, we identify ourselves clearly in each message, and we include a working unsubscribe mechanism. You can opt out of marketing emails at any time using the unsubscribe link or by contacting our Helpdesk.

8. How we protect your information

We maintain physical, organizational, and technological safeguards appropriate to the sensitivity of the information to protect it against loss, theft, and unauthorized access, disclosure, copying, use, or modification. Only employees and authorized service providers who need the information to perform their duties are given access to it. Where we retain paper records, they are stored securely.

Please note that no method of transmission over the internet is completely secure. Email in particular can be intercepted; if you need to send us sensitive information, please contact us by phone or arrange a secure method.

9. Personal information we handle on behalf of clients

As a marketing agency, we often process personal information on behalf of our clients — for example, leads and customer data collected through campaigns, landing pages, and websites we build and manage. When we act as a service provider in this way, we handle that information under the direction of, and in accordance with our agreements with, the client, who is responsible for its collection and for their own privacy practices. This Privacy Policy governs personal information for which Blue Ocean is responsible; it does not govern our clients’ own privacy practices.

10. Retention and disposal

We retain personal information only as long as necessary to fulfill the purposes for which it was collected and to meet legal, tax, and contractual requirements. When personal information is no longer needed, we securely destroy, erase, or anonymize it. Retention periods for employee and applicant records follow applicable employment standards legislation.

11. Your rights: access and correction

Subject to certain exceptions permitted by law, you have the right to access the personal information we hold about you and to request corrections. To make a request, contact our Helpdesk at helpdesk@blueoceaninteractive.com. We will respond within 30 days of receiving your request, or notify you if we need more time.

We may be unable to fulfill a request in limited circumstances — for example, where doing so would reveal another person’s personal information, breach solicitor-client or litigation privilege, disclose confidential commercial information, threaten someone’s safety, or where the law otherwise permits refusal. If we refuse, we will explain why.

12. Quebec residents

If you are located in Quebec, additional rights apply to you under Quebec’s Law 25. These include the right to withdraw consent, to request that your personal information be de-indexed or deleted in certain circumstances, and to data portability. We obtain express consent for sensitive personal information, apply privacy-protective settings by default, and will inform you where a decision about you is based solely on automated processing. 13. International visitors

If you access our site from outside Canada, please be aware that your information will be processed in Canada and, potentially, other jurisdictions. Depending on where you are located, you may have additional rights under laws such as the EU/UK GDPR or the California privacy laws (including rights of access, deletion, and objection). 14. Links to other websites

Our website may contain links to sites operated by third parties. This Privacy Policy does not apply to those sites, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any site you visit.

15. Children’s privacy

Our website and services are directed to businesses and are not intended for children. We do not knowingly collect personal information from children.

16. Privacy breaches

If a breach of security safeguards involving your personal information creates a real risk of significant harm to you, we will notify you and report to the Office of the Privacy Commissioner of Canada as required by law, and take steps to reduce the risk of harm. We maintain records of breaches as required.
